Heard Sri V.Nitesh, learned Counsel for Petitioners and of Sri K.G.Krishnamuthy, learned Senior Counsel appearing for Sri K.Raghu Veer, learned Counsel for Respondent No.2. 3. At the time of initial hearing of this matter, as per the directions of this Court dated 24.11.2025 the Police have complied with the provisions of Section 41-A of Criminal Procedure Code corresponding Section 35(3) of the B.N.S.S. The investigation is at progressive stage. Equally, whether the Petitioners have committed the alleged offences or not is a subject matter of thorough investigation, inasmuch as there are certain allegations leveled against them by Respondent No.2. At this juncture, it is not legally reasonable and permissible to examine the F.I.R., and undertake the exercise of quashment of the proceedings, for this simple reason that this court cannot legitimately stifle the process of the investigation. 4. In view of the above, the Criminal Petition is disposed of, granting liberty to the Petitioners to approach this Court at appropriate time with suitable petition, after filing of the charge sheet. _________________________ DR.
