Counter affidavit has been filed during the court proceedings, which is taken on record. 3. This anticipatory bail application has been filed by the petitioner who is apprehending arrest in connection with ACB Ranchi P.S. Case No. 01/2026 , registered for the offence punishable under Sections 420, 467, 468, 471, 120B and 109 of the Indian Penal Code (corresponding to Sections 318, 336, 338, 340, 61, and 49 of the BNS, 2023) and Sections 12 / 13(2) read with Section 13(1)(a) of the Prevention of Corruption (Amendment) Act, 2018, said to be pending in the court of learned A.J.C. VIII cum Spl. Judge ACB, Ranchi. 4. Learned counsel for the petitioner further submits that the petitioner happens to be the power of attorney holder, inter alia, with respect to the property involved in this case and pursuant to the power of attorney, he sold the property to his wife by way of a registered sale deed. The learned counsel further submits that the power of attorney was executed by the persons who claimed to be the descendants of the recorded tenant. 5. The learned counsel for the petitioner thereafter submits that the petitioner was granted interim protection by this court and was directed to appear before Anti-Corruption Bureau (ACB), Ranchi on 17.08.2026 at 11 a.m. along with the documents he wished to produce and to cooperate with the investigation. Pursuant to such order, the 2026:JHHC:28171 2 petitioner appeared before the Anti-Corruption Bureau and he submitted the photocopies of the documents, whatever was available with him. The learned counsel submits that the petitioner has nothing to say further. 6. The learned counsel for the petitioner has further submitted that the petitioner is otherwise bed-ridden as he has been subjected to major operation. The learned counsel submits that the petitioner may be extended the benefit of anticipatory bail. 7. The learned counsel for the petitioner also submits that the co- accused namely, Sumitra Kumari Baraik and Munni Kumari have been extended the privilege of anticipatory bail by this Court vide order dated 09.07.2026 passed in A.B.A. No. 3528 of 2026. 8. Learned counsel for the opposite party-ACB has opposed the prayer for anticipatory bail and has submitted that the persons who have been extended the privilege of anticipatory bail were not the power of attorney holders, rather they were the purchasers of the property from the power of attorney holder. However, the other submissions made by the learned counsel for the petitioner are not in dispute, including the fact that the petitioner is bedridden. 9. After hearing the learned counsels for the parties and considering the fact that the petitioner has acted through registered documents and is also bed-ridden coupled with the fact that the co- accused namely, Sumitra Kumari Baraik and Munni Kumari, who had purchased the property, have already been extended the privilege of anticipatory bail, the petitioner is also extended the privilege of anticipatory bail. 10. Hence, in the event of his arrest by the police or surrender within two weeks from today, the petitioner shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty-Five Thousand only) with two sureties of the like amount each to the satisfaction of learned A.J.C. VIII cum Spl. Judge ACB, Ranchi in connection with ACB Ranchi P.S. Case No. 01/2026 subject to the following conditions: - 2026:JHHC:28171 3 (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (iv) The petitioner shall cooperate with the investigation of the case and fully co-operate with the trial and at the stage of trial shall attend the court on each and every date failing which the bail bond will be cancelled by the learned court. 11.
