1. This is the 1st bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicant who has been arrested in connection with Crime No.17/2026 registered at Police Station – Kotwali, District- Raipur (C.G.), for the offences under Sections 25 & 27 of Arms Act.

2 Raipur, allegedly received secret information that the Applicant/accused was standing near the slope of Nehru Nagar, Raipur (C.G.) and was threatening passers-by while illegally possessing a knife. Acting upon the said information, the police party reached the spot and in the presence of independent witnesses, allegedly recovered and seized one sharp-edged iron knife from the possession of the Applicant/accused. Based on the aforesaid allegations, the police registered the offences as mentioned above against the present Applicant. Hence, this application.

Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. It is contended that the alleged seizure has been made by the police party itself and there is no independent witness to support the prosecution case. It is further submitted that the alleged knife is an ordinary iron knife and there is no allegation of its use for causing any injury to any person. He further submits that investigation is complete and charge-sheet has been filed, the Applicant is in jail since 21.01.2026 and the trial is likely to take considerable time for its conclusion, therefore, he may be enlarged on regular bail.
4. On the other hand, learned State Counsel opposes the bail application and submits that there are 5 previous criminal
3 antecedents against the present Applicant out of which, two are of similar nature, therefore, it is prayed that the bail application may be rejected.

Considering the facts and circumstances of the case, nature of allegations against the Applicant, the fact that he has five criminal antecedents out of which, two are of similar nature which goes to show that he is a habitual offender and also in light of the judgment rendered by the Supreme Court in Deepak Yadav v. State of Uttar Pradesh & Another, reported in (2022) 8 SCC 559, wherein the Hon’ble Supreme Court had cancelled the bail granted to the accused therein on the ground that the accused had previous antecedents, this Court is of the opinion that this is not a fit case to enlarge the Applicant on regular bail.
6. Accordingly, the bail application of the applicant – Mukesh Pal involved in Crime No.17/2026 registered at Police Station – Kotwali, District- Raipur (C.G.), for the offences under Sections 25 & 27 of Arms Act is hereby rejected.
7. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information.
