Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is contended that the charge-sheet has already been filed and, therefore, there is no likelihood of the applicant influencing the prosecution witnesses or tampering with the evidence. It is further submitted that the alleged offences are not punishable with death or imprisonment for life and that the applicant has been in judicial custody since 05.04.2026. Learned counsel submits that the applicant and the deceased had known each other since childhood and shared a cordial and consensual relationship, and the applicant never intended to cause any mental or physical harm to her. It is argued that, prior to the incident, the deceased was subjected to physical
3 assault and harassment by her father and brother on account of her telephonic conversation with the applicant, due to which she was under severe mental distress. It is further submitted that the deceased consumed poison on her own at a temple and thereafter telephoned the applicant seeking help, whereupon the applicant immediately rushed to the spot, shifted her on his motorcycle to the Government Hospital for treatment, and made every possible effort to save her life, which clearly demonstrates the absence of any criminal intention on his part. Learned counsel further submits that the prosecution story is false and has been fabricated by suppressing material facts with a view to maliciously implicate the applicant. It is also submitted that the applicant is the sole breadwinner of his family and his continued incarceration is causing severe hardship to his dependents. The applicant is a permanent resident of the address mentioned in the cause title, there is no likelihood of his absconding or tampering with the prosecution evidence, he undertakes to appear before the trial Court on each and every date fixed during trial, and is ready to furnish adequate surety and abide by all such terms and conditions as may be imposed by this Hon'ble Court while granting him the benefit of bail. 4. On the other hand, learned State Counsel opposed the bail application and submitted that the material collected during the course of investigation prima facie establishes the involvement of the applicant in the alleged offence.
It was contended that the father of the deceased specifically alleged that the applicant had been harassing and pressurising the deceased to marry him and had abetted her to commit suicide, pursuant to which Crime No. 65/2026 was registered
4 under Section 108 of the Bharatiya Nyaya Sanhita, 2023. Learned State Counsel further submitted that the statements of the prosecution witnesses support the prosecution case and, considering the seriousness of the allegations and the material available on record, the applicant is not entitled to the benefit of bail. Accordingly, it was prayed that the bail application be dismissed. 5. I have heard learned counsel for the parties and perused the case diary. 6. Having heard learned counsel for the parties and upon perusal of the case diary and the material available on record, this Court finds that the father of the deceased has made specific allegations that the applicant had been continuously pressurising the deceased to marry him and, upon her refusal, had harassed and instigated her to commit suicide. The material collected during the course of investigation, including the statements of the prosecution witnesses, prima facie supports the prosecution case. Looking to the nature and gravity of the allegations, the seriousness of the offence, and the material available on record, this Court is of the considered opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant – Karan Prasad Lahre, involved in Crime No. 65/2026, registered at Police Station - Bankimogra, District - Korba (C.G) for the offence punishable under Section 108 of the BNS, is rejected.
