Learned counsel for the petitioner is present.
2. Notice to respondent is held sufficient, since postal shara in respect of respondent shows ‘unclaimed'.
3. There is no representation on behalf of respondent.
4. Heard the arguments of learned counsel for the petitioner.
5. This civil petition is filed by the petitioner/wife seeking transfer of M.C.No.247/2026, filed by husband for restitution of conjugal rights before the Family Court Judge, Mysuru. It is submitted that both the petitioners are doctors. Petitioner is staying with her parents along with her child. Her mother is aged 70 years and son aged four years. The petitioner is working in a private nursing home at

Shivamogga. The distance between Mysore and Shivamogga is 251 kms. She has stated that it is inconvenient to take the child along with her for attending the Court as her mother is unable to take care of the child. She is also afraid of assault on her by her husband as he has got good contacts in Mysore and many of his relatives are residing in Mysore. She has also filed M.C.No.108/2026 for divorce before Family Court, Shivamogga.

Considering the arguments of learned counsel for the petitioner in the absence of respondent's arguments and also fact that other matters are pending before the Family Court, Shivamogga, this court finds it just and reasonable to transfer M.C.No.247/2026 filed for restitution of conjugal rights by the respondent/husband from the Family Court, Mysuru, to Family Court, Shivamogga to try along with M.C.No.108/2026 filed by the petitioner/wife for divorce. The family Court is specifically directed to club both the proceedings and to dispose of them together, in order to avoid conflicting judgments.

Accordingly, the civil petition is allowed.
