Accused No.1 in Crime No.162 of 2026 registered by Tumakuru Rural Police Station, Tumakuru District for offences punishable under Sections 108, 86, 74 R/w Section 3(5) of BNS, 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.162 of 2026 was registered by Tumakuru Rural Police Station, Tumakuru for the aforesaid offences against Hanumanthraju and others, based on the first information dated 07.06.2026 received from Smt.Mangalamma, mother of deceased Kalavathi. Apprehending arrest in the said case, petitioner had filed Crl.Misc.No.887 of 2026 before the jurisdictional Sessions Court which was rejected on 18.06.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, petitioner herein is the husband of deceased Kalavathi. It appears that marriage of petitioner with the deceased was - 3 - HC-KAR NC: 2026:KHC:33785 CRL.P No. 9236 of 2026 solemnized on 29.01.2020 and 30.01.2020. Allegation in the first information is that after the marriage, the petitioner and his family members were not properly looking after Kalavathi and she was being harassed and tortured in her matrimonial house. 5. From the averments found in the first information, it is very clear that for the last nearly about 2 years, deceased was staying in her parents' house and it appears that there was a dispute between the petitioner and his wife with regard to custody of their child. On 07.06.2026, deceased had committed suicide in her parents' house when her parents and relatives had gone to see a girl for the purpose of performing the marriage of the brother of the deceased. 6. In the first information, there is no mention of any such act committed by the petitioner herein immediately prior to the deceased committing suicide, which would have either abetted or instigated her to take the drastic step of committing suicide. Petitioner who is husband of deceased has undertaken to cooperate with the police for the purpose of investigation. - 4 - HC-KAR NC: 2026:KHC:33785 CRL.P No. 9236 of 2026 Accused no.2 has been granted anticipatory bail by this Court in Crl.P.No.9251/2026 disposed of on 03.07.2026. 7. Accordingly, the following: ORDER The Criminal Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.162 of 2026 registered by Tumakuru Rural Police Station, Tumakuru for offences punishable under Sections 108, 86, 74 R/w Section 3(5) of BNS, 2023 subject to the following conditions: 1. The petitioner shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court. 2. The petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 - HC-KAR NC: 2026:KHC:33785 CRL.P No. 9236 of 2026 3. The petitioner shall not tamper with the prosecution witness and he shall co-operate with the Police for investigation and appear before them whenever called upon. 4.
