PUBLIC PROSECUTOR The Court made the following: 3 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI CRIMINAL PETITION NO: 4441 OF 2026 ORDER:- The Criminal Petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), has been filed by the petitioner/A-1 seeking anticipatory bail in connection with Crime No.85 of 2026 of Tirupati East Police Station, Tirupati, registered for the offences punishable under Sections 69, 83, 351(2) read with Section 3(5) of BNS, 2023. 2. Heard Sri P. Nanilu Naidu, learned counsel for the petitioner, and the learned Assistant Public Prosecutor representing the respondent/State. Perused the record. 3. Learned counsel for the petitioner submitted that the petitioner has not committed any offence, as alleged in the complaint, and further states that the de facto complainant is habituated to file such complaints and she filed similar complaints in Crime No.113 of 2018 dated 09.08.2018 on the file of Nandyal Town Police Station for the offences punishable under Sections 420, 354(b) and 506 I.P.C. and also Crime No.353 of 2023 dated 31.03.2023 on the file of Rayachoty Police Station for the offences punishable under Sections 417 and 376 I.P.C. 4. Learned Assistant Public Prosecutor opposed the same and strenuously contended that the police examined five witnesses and a 4 certificate was obtained from the Assistant Professor, Government Hospital, Tirupati in which it is mentioned that there is no recent cohabitation with the de facto complainant. 5. Considering the rival submissions, this Court is inclined to grant bail to the petitioner. 6. Accordingly, the Criminal Petition is allowed with the following conditions: (a) The Petitioner/accused is directed to surrender before the Tirupati East Police Station, Tirupati, within a period of two (2) weeks from today and on such surrender, the Petitioner/accused shall be released on bail on furnishing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties for a like sum each to the satisfaction of the Station House Officer, Tirupati East Police Station, Tirupati. (b) The petitioner/accused shall appear before the Investigating Officer once in a week i.e., every Sunday between 10.00 AM and 01.00 PM for three (03) months or till filing of the charge sheet, whichever is earlier. (c) The petitioner shall make himself available for Investigation/interrogation by a police officer as and when required. (d) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with 5 the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. (e) The petitioner shall not leave India and shall not interfere with the investigation. He shall not threaten the witnesses and also the de facto complainant. (f) The petitioner shall surrender passport, if any, or submit an affidavit that he will not leave India. (g) The petitioner shall scrupulously comply with the above conditions and breach of any of them will be viewed seriously. The Prosecution is at liberty to move an application for cancellation of the bail. The findings recorded herein are only for the purpose of disposal of this bail petition.
