W.P.No.37151_2012 THE HONOURABLE SRI JUSTICE HARINATH.N WRIT PETITION NO: 37151 of 2012
ORDER:
1. The learned counsel appearing for the petitioners submits that the petitioners are working as Paricharikas in Sri Pattabhi Ramaswamy Temple, Valmikipuram, and seek a writ of mandamus to direct the respondent- Devasthanam to absorb them into its regular service.
2. It is submitted that the petitioners are as on date, discharging the duties of Paricharikas in the said Temple on receipt of a fixed Sambhavan. The
learned counsel appearing for the petitioners further submits that upon Sri Pattabhi Ramaswamy Temple being taken over by the respondent for management and administration, the services of the petitioners ought to have been regularized and they ought to have been absorbed into the service of the respondent. It is further submitted that the petitioners are entitled to be placed on time-scale of pay with effect from 23.02.1997, being the date on which the Temple was taken over by the respondent. 3. The learned Standing counsel appearing for Tirumala Tirupathi Devasthanam (TTD), on behalf of the respondent, submits that the petitioners were not regular employees of Sri Pattabhi Ramaswamy Temple. It is submitted that at the time of taking over the said Temple, the Government issued G.O.Ms.No.1536, dated 20.12.2008, under which only certain categories of employees, namely Archakas, Melam staff, Watchman and

W.P.No.37151_2012 Sweeper, who were working as regular employees of Sri Pattabhi Ramaswamy Temple, were taken over and absorbed into the service of the respondent. The petitioners did not figure in the said list and, therefore, cannot claim any right to absorption. It is further submitted that several temples requiring better management were taken over by the TTD, and only those employees who were holding sanctioned posts were absorbed. It is submitted that payment of Sambhavan cannot be equated with payment of salary and does not confer any legal right to seek regular appointment. 4. In reply, the learned counsel appearing for the petitioners submits that even as per the proceedings dated 15.04.2011, whereby the respondent refixed the Sambhavan payable to the petitioners at Rs.12,000/- per month with effect from 21.03.2011. It was mentioned that, the request of the petitioners for absorption would be considered at the time of issuance of a notification proposed to be issued shortly. It is submitted that, till date, no such notification has been issued. 5. Considering the submissions, it is made clear that the petitioners cannot, as a matter of right, seek absorption solely on the basis of their engagement as Paricharikas on Sambhavan basis, this Court deems it appropriate to observe that the petitioners’ services may be continued and that their cases may be considered strictly in accordance with law, as and when the respondent issues a notification. 5
