Learned counsel for the petitioner, on instructions, seeks leave to withdraw this petition since counter affidavit filed on behalf of the (2026: JHHC: 9512-DB) respondents indicates that 40% of the tendered work is already complete. He however seeks liberty to the petitioner to file a suit for claiming damages on the ground of non-consideration of his tender and the damages sustained on that ground. 2. By keeping open all the contentions of all the parties on merits of the matter or the legality and validity of the petitioner’s contention, we grant the petitioner leave to withdraw this petition with liberty to file a suit seeking appropriate reliefs. We clarify that we have not examined any of the rival contentions on merits and therefore, all contention of all parties are left open to be decided in the suit that the petitioner might institute. 3.
