1. Heard the parties.
2. This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 482 of the Code of Criminal Procedure with the prayer to quash/set aside the First Information Report being Chutiya P.S. Case No. 170 of 2020 dated 10.10.2020.

3. Learned counsel for the petitioner draws attention of this Court towards Annexure-3 at running page No.28 of the instant Criminal Miscellaneous Petition which is the copy of the certified copy of the Final Report and submits that police after investigation of the case, has submitted Final Report for lack of evidence and has not sent up the petitioner for trial.
4. Since police has not sent up the petitioner for trial, so, this Court is of the considered view that there is no justifiable reason to quash the First Information Report being Chutiya P.S. Case No. 170 of 2020 when the police after investigation of the case, has submitted Final Report and has not sent him up for trial.
5. In view of filing of the Final Report by the police by not sending up the petitioner for trial, this Criminal Miscellaneous Petition is dismissed being infructuous.
6. Consequent upon dismissal of this Criminal Miscellaneous Petition, interlocutory applications, filed if any, is dismissed being infructuous.
