Ms. Anushri Mishra, Advocate would submit that father of the petitioner Late Akhtar Ali was working on the post of Operator under the respondents, who died in harness on 16.08.1999. She would submit that mother of the petitioner moved an application before the respondents on 17.11.2000 claiming therein compassionate appointment, but no decision was taken. The petitioner, who is son of the petitioner made a representation before the respondents claiming therein compassionate appointment on 30.12.2005, but till date it has not been considered and decided. She would submit that a direction may be issued to the respondents to decide the pending applications. 3. On the other hand, Mr. Shukla would submit that father of the petitioner died in the year 1999 and since then 26 years have already passed and the petitioner’s family has already survived for such a long period, and therefore, the claim of the petitioner deserves to be rejected. It is also contended that the petitioner approached the respondent authorities in the year 2005 after 6 years from date of death of his father, and thus, his application was beyond period of limitation prescribed in the policy. It is also argued that after death of Late Akhtar Ali, mother of the petitioner opted for employees’ superannuation benefits, and therefore, the petitioner is not entitled for grant of compassionate appointment. He would submit that writ petition deserves to be dismissed. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. Father of the petitioner, namely, Akhtar Ali died in harness on 16.08.1999, who was working on the post of Operator under the respondents. 3 Applications were moved by the mother of the petitioner and petitioner for grant of compassionate appointment on 17.11.2000 and 30.12.2005, but till date those applications have not been decided. 6. Having considered facts discussed-above, without expressing any opinion on the merits of the case, the respondent authorities are directed to decide the pending representations/applications moved by the petitioner and his mother expeditiously, preferably within a period of 120 days. 7.
