Mr. Sachin Kumar, A.C. to S.C.IV. ------ Order No:-04 Dated:-18-09-2026 Heard the parties. This civil miscellaneous petition has been filed by the petitioners with the prayer for restoration of F.A. No. 261 of 2023 to its original file which stood dismissed for non-compliance of the order dated 05.12.2024. Learned counsel for the petitioners submits that F.A. No. 261 of 2023 stood dismissed for non-compliance of the order dated 05.12.2024 in which the appellants of F.A. No.261 of 2023 was directed to remove the defects as pointed out by the stamp reporter. It is next submitted by the learned counsel for the petitioners that the petitioners were unable to arrange the court fees amount; due to which the said order could not be complied with. It is also submitted that the petitioners have very good ground to agitate in the said F.A. No. 261 of 2023 and unless the same is restored to its original file, the petitioners will be highly prejudiced. Hence, it is submitted that the F.A. No. 261 of 2023 be restored to its original file. Learned counsel for the State has not raised any serious objection to the prayer of the petitioners. Considering the facts of the case and the aforesaid submission of the learned counsel for the petitioners, F.A. No. 261 of 2023 be restored to its original file at the same stage at which it was before its dismissal. Registry is directed to list F.A. No. 261 of 2023 before the appropriate Bench after a week.
