The prayer in the present petition under Section 483 BNSS is for the grant of regular bail in case bearing FIR No.28 dated 14.05.2018 under Sections 302, 364, 201, 148 and 149 IPC, registered at Police Station Khem Karan, District Tarn Taran. 2. The learned counsel for the petitioner contends that though it is a case of honour killing, the petitioner being the servant of Jassa Singh, the father of the deceased, namely Ramandeep Kaur has now undergone custody of 8 years. However, only 14 of the 29 prosecution witnesses have been examined so far. Therefore, the Trial of the present case is not likely to be concluded anytime soon. Hence, the petitioner is entitled to the concession of regular bail, moreso, when all the co-accused have been granted the similar concession. 3. ::2:: that the allegations of honour killing are indeed grave and therefore, the petitioner is not entitled to the concession as prayed for. He, however, concedes that the petitioner is in custody since 16.05.2018 but only 14 of the 29 prosecution witnesses have been examined so far and all the co-accused of the petitioner have been granted the concession of regular bail. 4. I have heard the learned counsel for the parties. 5. The veracity of the prosecution case against the petitioner and his co-accused shall be adjudicated upon during the course of the Trial. Admittedly, the petitioner is in custody since 16.05.2018 but only 14 of the 29 prosecution witnesses has been examined so far. Therefore, the Trial in the present case is not likely to be concluded anytime soon. In this situation, the further incarceration of the petitioner is not required. 6.
Thus without commenting on the merits of the case, the present petition is allowed and the petitioner-Ramesh Kumar @ Raju Bahiya is ordered to be released on bail subject to his furnishing bail bonds and surety bonds to the satisfaction of learned CJM/Duty Magistrate, concerned. 7.
