Lenka, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 14.07.2026 01. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with Balugaon P.S. Case No. 252 of 2026, corresponding to G.R. Case No. 389 of 2026 pending in the file of the learned J.M.F.C., Chilika on the grounds stated. 3. Perused the F.I.R. as at Annexure-1. It is submitted that the petitioner is the owner of the vehicle which was involved in the alleged transportation of laterite stone. The vehicle in question was intercepted by the local police with the laterite stone. In that connection, being the owner of the vehicle, the petitioner apprehends arrest. Considering the above facts and submissions of learned counsel for the respective parties, this Court is inclined to direct the petitioner to surrender before the learned court below for being released with stringent conditions, even though, his bail plea is not entertained. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioner surrenders before the court of learned J.M.F.C., Chilika in connection with Balugaon P.S. Case No. 252 of 2026 corresponding to G.R. Case No. 389 of 2026 within a fortnight from today, he shall be released on bail upon furnishing a bail bond of Rs.30,000/- (rupees thirty thousand) each with one solvent surety for the like amount with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. The additional condition shall be that he shall furnish an undertaking at the P.S. concerned to ensure that the vehicle owned by him is not utilized for any such nefarious activities in future. 6.
