JUSTICE E.S.INDIRESH ORAL ORDER In this petition, petitioners are challenging the proceedings in Appeal No.220/2023-24 on the file of the respondent No.3 along with interim order dated 06th February, 2024. 2. Heard Sri. M.B. Naragund, learned Senior Counsel on behalf of Smt. Sumathi S., appearing for petitioners; Smt. B.P. Radha, learned Additional Government Advocate appearing for respondents 1 to 4; and Sri. Y.R. Sadasiva Reddy, learned Senior Counsel on behalf of Sri. Rahul S. Reddy, appearing for respondents 5 to 11. - 4 - HC-KAR NC: 2026:KHC:32703 WP NO.5567 OF 2024 3. Sri. M.B. Naragaund, learned Senior Counsel appearing for petitioners, by referring to the ordersheet produced at Annexure-A submits that the matter was posted for orders without extending an opportunity of hearing to the petitioners herein. Accordingly, learned Senior Counsel sought for interference of this Court. 4. Per contra, Sri. Y.R. Sadasiva Reddy, learned Senior Counsel appearing for respondents 5 to 11 argued that, what is pending consideration before the respondent No.3 is an appeal preferred against the order made in respect of phodi and durasth of the subject land. Accordingly, sought for dismissal of the petition. 5. Smt. B.P. Radha, learned Additional Government Advocate appearing for respondents 1 to 4 sought to justify the impugned proceedings. 6. In the light of submission made by learned counsel appearing for the parties, on careful consideration of the ordersheet produced at Annexure-A, particularly, the order dated 02nd February, 2024 passed by the respondent No.3 in the impugned proceedings, it is forthcoming that the appeal is - 5 - HC-KAR NC: 2026:KHC:32703 WP NO.5567 OF 2024 posted for orders, however, no orders have been passed pursuant to the same. In that view of the matter, as the petitioners contended that, they have not been extended opportunity of hearing in the matter and the final order has not been passed in the impugned proceedings till date, the respondent No.3 is directed to afford an opportunity of hearing to the petitioners herein and thereafter, take decision in the matter in accordance with law. 7. Since, the parties are represented through their respective learned counsels, parties are directed to appear before the respondent No.3 on 30th July, 2026 at 02.30 p.m. The respondent No.3 shall conclude the proceedings in Appeal No.220/2023-24 within an outer limit of three months from the date of appearance of the parties.
