JUSTICE DEEPAK GUPTA Present:- Mr. Gurjeet Singh, Advocate for the peoner. DEEPAK GUPTA , J.(Oral) Peoner herein is the plainff in a Civil Suit No.CS-CJ-74 of 2024, tled as “Mukul Thakur v. Kreave Events and others”, pending before learned Civil Judge (Jr. Divn.), Chandigarh. He is aggrieved by the order dated 15.04.2026 (Annexure P-1), whereby ex parte proceedings earlier iniated against respondents-defendants, were set aside. 2. It is argued by learned counsel for the peoner that respondents were proceeded ex parte on 15.04.2024 and that without assigning any reason or jusficaon, ex parte proceedings have been set aside. 3. A perusal of the impugned order would reveal that it was pleaded by the respondents that respondent No.1 used to visit abroad, whereas respondent No.2 was an employee. He could not appear before the Court due to lack of the knowledge regarding the pendency of the suit. Even otherwise, the ma6er was at the preliminary stage. 4. Having noced the aforesaid facts and circumstances, no illegality can be found in the impugned order. Even otherwise, it is the discreon of the trial Court to set aside the ex parte proceedings and discreon has been exercised correctly. Dismissed.
