Bose, learned Standing Counsel for Guntur Municipal Corporation. 2. Learned Counsel for the Writ Petitioner has drawn the attention of this Court to the photographs in Ex.P.2. He would submit that new construction which is going on, as shown in the photographs, is in fact a public Well, over which the Respondent No.3 has not only encroached upon the said Well but has also undertaken construction, as is visible in the photographs. It transpires from record that the Notice sent to Respondent No.3 was refused by him. Therefore, vide Order dated 06.02.2026, this Court has recorded the same as deemed service and adjourned the matter to today to enable the Respondent No.3 to enter appearance, either in-person or through a Counsel, as a final opportunity. 3. Sri Harsha S Ammineni, learned Counsel appearing on behalf of Sri A.S.C. Bose, learned Standing Counsel for Guntur Municipal Corporation, has submitted the Written Instructions furnished by the City Planner, Guntur Municipal Corporation dated 03.12.2025. The Written Instruction from the City Planner would indicate that the subject site is not a Well and the same was informed to the Writ Petitioner when he filed PGRS Complaint. 4. Having considered the Written Instruction furnished by the City Planner, Guntur Municipal Corporation dated 03.12.2025, learned Counsel for the Writ Petitioner seeks to withdraw this Writ Petition with liberty to approach the Municipal Corporation along with material to indicate that the subject site was originally a public well. 3 5. Having recorded the said submission, this Writ Petition is dismissed as withdrawn by granting liberty to the Writ Petitioner to explore the legal avenues as available to him under law.
