Issue a Writ of Mandamus directing the Respondents to consider the representation of the - 3 - HC-KAR NC: 2026:KHC:33499-DB WP No. 32075 of 2025 petitioner to regularize the house property No.212 measuring 50 x 30 situated at Kasagattapura, at Byalakere village, Hesaraghatta Hobli, Bengaluru North Taluk, Bengaluru in Dr.K.Shivaram Karantha layout, Bengaluru, vide produced as Annexure-D.. b. Grant such other relief or reliefs as the case may be, that this Honorable Tribunal deem fit in the facts and circumstances of the case in the interest of justice and equity." 2. Heard Sri N.Manohar, learned counsel for the petitioner, Smt. Hemalatha V., learned AGA for respondent No.1 - State and Sri Shivaprasad M. Shanthanagoudar, learned Standing counsel for respondent Nos.2 and 3 - BDA. 3. Sri Manohar, learned counsel for the petitioner contended that, the petitioner is absolute owner of Site No.212, at Kasaghattapura, Byalakere village, Hesaraghatta Hobli, Benglauru North Taluk. He purchased the said property on 01.12.2006 from his vendor. In the meanwhile, the respondents have issued preliminary notification and final notification for acquisition of land of petitioner and others for Dr. K.Shivaram Karanth layout, hence, the petitioner submitted his representation to the respondents - BDA for regularisation - 4 - HC-KAR NC: 2026:KHC:33499-DB WP No. 32075 of 2025 of his Site on 02.09.2025 vides Annexure-D. The representation not having met its consideration has preferred this petition before this Court. 4. Sri Shivaprasad Shanthanagoudar, learned counsel for the respondents - BDA submits that, if reasonable time is granted, the representation of the petitioner would be considered and necessary orders would be passed in accordance with law. 5. In the light of the aforesaid submissions, we deem it appropriate to pass the following: ORDER [I] The Writ Petition is allowed. [II] The respondents-the Bengaluru Development Authority (now Greater Bengaluru Authority), to consider the representation submitted by the petitioner dated 02.09.2025 (Annexure- D), which has acknowledgment bearing No.452420 dated 02.09.2025, forthwith. [III] The respondents - the Bengaluru Development Authority shall also - 5 - HC-KAR NC: 2026:KHC:33499-DB WP No. 32075 of 2025 communicate the order that would be passed on the representation, to the petitioner. [IV] Till the consideration of the representation happens, the parties are directed to maintain status quo, qua the property of the petitioner. Ordered accordingly.
