2.
Learned counsel for the petitioner submits that the accused- petitioner has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further submits that the petitioner was initially taken into custody in the year 2022 and in the present FIR, the petitioner was arrested on 07.02.2025 and he has been in custody since then. He also submits that the present case is triable by a Court of Magistrate; charge-sheet has already been filed in the matter, no recovery is required to be made from the petitioner and trial will take considerably long time in its conclusion, so no fruitful purpose would be served by keeping the petitioner in custody, therefore, the
[2026:RJ-JP:9244] (2 of 3) [CRLMB-1728/2026] benefit of bail under Section 483 B.N.S.S. may be granted to the accused-petitioner.
3. Per contra, learned Public Prosecutor opposes the submissions made by learned counsel for the petitioner hereinabove and submits that 115 other cases have been registered against the petitioner.
4. In response to the factum of 115 other cases against the petitioner,
learned counsel for the petitioner submits that all these cases have been registered on the basis of same allegations levelled by the different persons. He further contends that in some of these cases, the petitioner has already been enlarged on bail by the Co-ordinate Benches of this Court and in one case, he has been granted benefit of bail by the Hon’ble Supreme Court.
5. Heard and perused the material available on record.
6. Taking into consideration the overall facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, the fact that case is triable by a Court of Magistrate, charge-sheet has already been filed in the matter and trial will take considerably long time in its conclusion, without commenting anything on the merits / demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.
7. The bail application is accordingly allowed and it is directed that accused-petitioner, namely Murli Manohar S/o Badrilal, shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
