GP FOR REVENUE 2 The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue order or orders, direction or directions. Writ or Writs particularly one in the nature Writ of Mandamous or any appropriate writ declare the action of the respondents in attempted to demolish the petitioner's residential house in an Extent of 144 Sq.Yd situated in a assessment No 703 constructed in 144 Sq. Yrds in Sy No 57/9 plot no 47 and 48 Palasavalsa(V) Anadapuram (M) Visakhapatnam is illegal , arbitrary, against the principles of natural justice and violative of Articles 14, 21 and 300A of the constitution of India and consequently direct the respondent to follow the due process of law before taking any coercive steps on the petitioners above lands…” 2. Heard learned counsel for the Petitioner and the learned Assistant Government Pleader for Revenue Department. 3. Mr. K.L.N. Swamy, learned counsel for the Petitioner, submits that the Respondents are attempting to demolish the Petitioner’s residential house without following due process of law. 4. Sri B. Venkata Satyanarayana, learned Assistant Government Pleader for Revenue, on written instructions, submits that the Petitioner has illegally occupied Government land. Complaints have been received from villagers regarding encroachment of Government land and Gedda Porambok by the Petitioner. Encroachment removal action was initiated on 04.05.2026 in accordance with law. During the drive, recently erected asbestos sheds and cement basements in vacant encroached plots were removed. It is alleged that the Petitioner attempted to encroach upon the subject land by undertaking construction of a slabbed structure with a dubious Layout Permission Certificate. 3 5. The learned Government Pleader submits that no notice was issued to the Petitioner alleging illegal occupation, and without issuing such notice and following due process of law, the disputed structures cannot be demolished. 6. Having regard to the facts and circumstances of the case, and recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent Nos.2 to 4 not to demolish the structures of the Petitioner on the disputed land without following due process of law as contemplated under the applicable rules and regulations. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr.Y.
