By means of this criminal misc. application, applicant has sought quashing of Non-Bailable Warrants issued to him by learned Additional Chief Judicial Magistrate-II, Dehradun in Criminal Case No.1351 of 2017. 3. On the last occasion, the Coordinate Bench of this Court had directed the learned State Counsel to obtain instructions in the matter. Today, learned State Counsel, on instructions, submits that a bare perusal of the order sheet of the learned trial Court would reveal that Non-Bailable Warrants were issued against the applicant on 11.09.2023, followed by issuance of further warrants on subsequent dates, and once again on 02.01.2026. 4. Learned State Counsel further submits that the applicant has a statutory remedy to appear before the learned trial Court and to move an appropriate application for recall of the Non-Bailable Warrants. 5. In view of the above, this Court refrains from exercising its jurisdiction under Section 528 of B.N.S. to quash the warrants. Accordingly, the criminal miscellaneous application is dismissed.
