JUSTICE A. GUNESHWAR SHARMA Order (Oral) 28.04.2026 [1] Heard Mr. K. Roshan, learned counsel along with Mr. Roscoe, learned counsel for the petitioner and Mr. S. Vijayanand Sharma, learned Sr. PCCG for the respondent. [2] The petitioner who is serving as Sub-Inspector (Pharma) in CRPF was posted at Composite Hospital (CH)-Imphal. The petitioner was earlier appointed as Assistant Sub-Inspector (Pharma) on 28.11.2006 and he was posted at Imphal since 25.03.2022 at 109 Bn., Mongsangei, Imphal West and upon his promotion to the post of Sub- Inspector (Pharma), he is posted at Composite Hospital-Imphal (Langjing) on 26.03.2025 till his transfer. Initially he was transferred vide order dated 30.01.2026 from Composite Hospital-Imphal to RTC Srinagar. Vide another order dated 30.01.2026, his wife was transferred from 109 Bn. Imphal to Composite Hospital-Hyderabad. [3] The petitioner submitted a representation dated 30.01.2026 for re-consideration of his transfer to Srinagar and requested for his transfer to CH-Hyderabad along with his wife. Thereafter, vide impugned order dated 27.02.2026, the petitioner’s transfer order was modified from RTC-Srinagar to 099 RAF which is at the distance of 50 Km. from Hyderabad. The petitioner also submitted another representation dated 02.03.2026 requesting that he may be posted with his wife at CH- Hyderabad or his wife may be posted with him at GC Hosp. Rangareddy and to retain both husband and wife at CH-Imphal. [4] Vide letter dated 25.03.2026 issued by DIG (Medical) CH- Imphal to the petitioner, his second representation dated 02.03.2026 was declined and directed to approach Director General, CRPF directly for personal audience in this regard. The petitioner challenged the transfer order dated 27.02.2026 at 099 RAF on the ground that he has not completed tenures of three years and he is entitled for spouse posting in terms of the standing order No. 04/2022 dated 07.10.2025 and also O.M. dated 24.11.2022 issued by the Department of Personnel, Public Grievances & Pensions (DoPT), Government of India. [5] Since the matter is regarding re-consideration of the transfer order, instead of issuing notice, this Court called for instruction from the respondents and vide order dated 15.04.2026, status quo as on date was directed to be maintained till next date and the interim order is extended from time to time. [6] Mr. S. Vijayanand Sharma, learned Sr. PCCG for the respondents, submits that the petitioner is posted at Imphal since 23.12.2022 and three years tenure as per the standing order has already completed. The petitioner has also availed spouse posting including in last posting at Imphal. [7] Mr. K. Roshan, learned counsel for the petitioner, submits that three years tenure in a station has to be calculated from the date of promotion. [8] Learned Sr. PCCG for the respondents has pointed out that as per the record, the petitioner and his wife were posted together in the same station at Imphal since 2022. Since there is no sufficient number of vacant post in the Sub-Inspector (Pharma) in the same unit/station, by the impugned order dated 27.02.2026, the petitioner is placed at the station nearest to his wife which is around 50 Km. from CH-Hyderabad. He further submits that regarding representation, in terms of the signal dated 03.04.2025, any personnel can submit representation to the Director General, CRPF by e-mail and the same will be considered by the authority without filtering. [9] This Court is of the view that writ petition may be disposed of at this stage without issuing notice. The request of the petitioner for re-consideration of his transfer to RTC-Srinagar has been duly considered by the authority and his transfer is modified to 099 RAF which is the nearest possible posting of his wife. [10] In the circumstances, writ petition is disposed of by giving liberty to the petitioner to submit a fresh representation to the Director General, CRPF for his posting in any suitable station preferably with his wife. Interim order dated 28.04.2026 stands vacated and is merged with the final order. [11] This Court does not express any opinion on the merit of the case.
