In this Writ Petition, petitioner is assailing the impugned notice bearing No.ALN/CR/104/2025-26 dated 10.06.2026 (Annexure-P) issued by respondent No.4. - 3 - HC-KAR NC: 2026:KHC:33237 WP No. 19981 of 2026 2. Sri. B.B. Sagar, learned counsel appearing for the petitioner, by referring to the impugned order at Annexure-P and Section 96(2) of the Karnataka Land Revenue Act, 1964 (for short, 'the Act'), submitted that the Tahsildar, Mulbagil Taluk, has no jurisdiction to issue notice to the petitioner which is contrary to the provisions of the Act and accordingly, sought for interference of this Court. 3. Per contra, learned Additional Government Advocate sought to justify the action of respondent No.4 and submitted that the said notice has been issued pursuant to the instruction of respondent No.2 and accordingly, sought for dismissal of the Writ Petition. 4. Taking into consideration the language employed at Section 96(2) of the Act, I am of the opinion that in the event of any violation of the conditions of the conversion order under Section 95 of the Act is concerned, only the Deputy Commissioner is empowered to issue such notice to such parties. In that view of the matter, the impugned notice dated 10.06.2026 issued by respondent No.4 is accordingly, set - 4 - HC-KAR NC: 2026:KHC:33237 WP No. 19981 of 2026 aside. However, it is open for the respondent No.2 to take action if any violation is found. 5. With the above observation, the Writ Petition stands allowed.
