This petition under Section 483(1)(b) of BNSS 2023 is filed with a prayer to relax condition number no.9 imposed in Crl.Misc.No.3793 of 2026 by the Court of LIII Additional City Civil & Sessions Judge, Bangalore vide order dated 07.05.2026. 2. Heard the learned counsel for the petitioner and learned HCGP on behalf of respondent - State. 3. Crl.Misc.No.3793 of 2026 was filed by the petitioner herein before the Court of jurisdiction Sessions Judge seeking regular bail in Crime No.114 of 2026 registered by Amruthahalli Police Station, Bangalore for offences punishable under Section 64 and Section 351(1) of BNS 2023. - 3 - HC-KAR NC: 2026:KHC:34172 CRL.P No. 7461 of 2026 4. The learned Sessions Judge, vide the order dated 07.05.2026 had allowed Crl.Misc.No.3793 of 2026 and had granted regular bail to the petitioner subject to certain conditions. Condition no.9 imposed by the learned Sessions Judge vide order dated 07.05.2026 in Crl.Misc.No.3793 of 2026 reads as follows: "9. He shall not leave the jurisdiction of the Court without prior permission". 5. Seeking relaxation of the said condition, petitioner had filed Crl.Misc.No.4630 of 2026 before the said Court, which was dismissed on 22.05.2026. Therefore, the petitioner is before this Court. 6. Learned counsel for the petitioner submits that petitioner is a businessman at Hyderabad and impugned condition imposed on him has been causing serious hardship and inconvenience to him. He submits that, investigation of the case is already completed and charge sheet is filed. Accordingly, he prays to allow petition. - 4 - HC-KAR NC: 2026:KHC:34172 CRL.P No. 7461 of 2026 7. Per contra, learned HCGP has not fairly oppose the prayer made by the petitioner. 8. It is not in dispute that the petitioner has complied all the other conditions imposed by the learned Sessions Judge in Crl.Misc.No.3793 of 2026 vide order dated 07.05.2026. Since it is brought to the notice of this court that the petitioner is a businessman at Hyderabad, if the impugned condition is relaxed, the same would serve the ends of justice. 9. Accordingly, the following:- ORDER (i) Criminal Petition is allowed. (ii) The impugned condition no.9 imposed by the Court of LIII Addl. City Civil & Sessions Judge, Bengaluru in Crl.Misc.No.3793 of 2026 vide order dated 07.05.2026 stands relaxed. (iii) All other conditions found in the said order remains unaltered.
