Pasala Ponna Rao, DEPUTY SOLICITOR GENERAL OF INDIA 2. . 3 The Court made the following: JUDGMENT: (Per Hon’ble Sri Justice K.Suresh Reddy) Questioning the order dt. 29.10.2025 in Crl.M.P.No.2729 of 2023 in Sessions Case No.11 of 2023 passed by the learned III Additional District & Sessions Judge–cum–Special Judge for SPE & ACB Cases, Visakhapatnam (for short, ‘the learned Special Judge’), dismissing the bail application, the appellant / A.1 filed the present Appeal. 2. Heard Sri P.Srinivasulu, learned counsel for the appellant / A.1, and Sri Challa Dhananjaya, learned Additional Solicitor General of India for the respondents. 3. We have perused the entire material on record. 4. The petitioner is A.1 in the above Sessions Case No.11 of 2023. The offences alleged against the petitioner are Section 120-B, 121, 121-A, 143, 144, 124(A) r/w 149 IPC, Sections 10, 13 and 18 of the Unlawful Activities (Prevention) Act, 1967, Sections 8(1)(2) of the Andhra Pradesh Public Security Act; and Section 25 of the Indian Arms Act. 5. It is pertinent to note that the earlier application filed by the petitioner was dismissed by the learned Special Judge, by order dt. 28.03.2024, vide Crl.M.P.No.335 of 2024. Aggrieved by the same, the appellant filed Criminal Appeal No.251 of 2024 before this Court, which was dismissed as withdrawn, vide order dt. 06.01.2025. Even before that, the petitioner approached the Hon’ble Supreme Court by filing a Special Leave Petition (Criminal) Diary 4 No.28373/2023. The Hon’ble Apex Court dismissed the said Special Leave Petition by order dt. 25.08.2023, the portion of which reads as under: “Delay condoned. Having regard to the nature of the allegations levelled against the petitioner and also the materials collected during the course of the investigation, we are of the view that no case is made out for bail. The petitioner appears to be in judicial custody past more than three years. We are informed that even charge has not been framed till this date. The trial Court shall see to it that the charge is framed at the earliest and the recording of the oral evidence begins. The special leave petition is, accordingly, dismissed. Pending application stands disposed of.” Even after negating the plea, again the appellant filed bail application before the learned Special Judge, which was ultimately dismissed. Aggrieved by the same, the appellant filed the present appeal. 6. Earlier, when the appeal came up for hearing, this Court directed the learned Special Judge to furnish a report as to why charges have not been framed in spite of the directions of the Hon’ble Supreme Court. Again, when the appeal was listed on 20.01.2026, a report is received from the learned Special Judge. In his report, learned Special Judge has stated that charges have already been framed and the case is posted for trial on 27.01.2026. He further stated in his report that the delay is on account of the delaying tactics adopted by the accused. Be that as it may, the Hon’ble Supreme Court has already dismissed the Special Leave Petition stating that no case is made out for grant of bail in view of the facts and circumstances of the case. 5 7. In view of the above, we are not inclined to grant bail to the appellant / A.1. As charges have already been framed and the case stands posted for trial on 27.01.2026, the learned Special Judge is directed to take up the Sessions Case for trial and complete the same as expeditiously as possible on a priority basis. The accused is directed to co-operate with the speedy disposal of the Sessions Case. With the above directions, this Criminal Appeal is disposed of at the admission stage. There shall be no order as to costs. As a sequel, interlocutory applications pending, if any, shall also stand closed. __________________ K.SURESH REDDY, J ____________________________ A.
