1. Petitioner has filed this petition seeking following relief (s) :-

2 dated 01.12.2025 passed by respondent No.2 which is arising out of transfer order dated 04.06.2025, passed by respondent No.5, in the interest of justice. 10.2 This Hon’ble Court may further be pleased to pass an appropriate order or issue writ as deemed fit under the facts and circumstances of the case.”

Learned counsel for petitioner submits that petitioner was shifted from Government Primary School Bada, Bock Rajpur, District Balrampur – Ramanujganj to Government Primary School Tukupathar, Block - Ramchandrapur, District Balrampur – Ramanujganj under rationalization scheme of the State Government. He contended that after passing of order dated 04.06.2025, petitioner had earlier filed Writ Petition (S) No. 5059 of 2025, which was disposed of permitting petitioner to submit representation before the Committee constituted under the notification dated 07.07.2025. Accordingly, petitioner submitted representation before the Commissioner and the President of Divisional Level Committed under rationalization scheme, however, the Committee headed by Divisional Commissioner has dismissed the representation without considering the grounds raised in appropriate manner. He contended that according to policy formulated by State Government for every 30 students in the primary school, there shall be one headmaster and one teacher and school in which the petitioner was posted the number of student was 57, therefore, there may one headmaster and two teachers.
3. Learned State counsel would opposes the submission of learned counsel for petitioner and would submit that the submission of learned counsel for petitioner is not correct. He submits that according to the policy of the State Government for every 30 students there shall be
3 one teacher and if there is only 30 students, there shall be single teacher only. He also pointed out that the headmaster of primary school are required to teach the students, therefore, he is also to be treated as teacher. In the government primary school, Bada, where the petitioner was earlier posted there were 57 students and already two teachers including headmaster primary school is posted. Petitioner was third teacher and therefore, she was in excess to the ratio fixed and is shifted to another school according to rationalization policy, which cannot be said to be erroneous.
4. On due consideration on the submission of learned counsel for parties, I do not find any good ground to interfere with the decision taken by the Divisional Commissioner vide Annexure P-1 dated 01.12.2025.
5. Accordingly, the writ petition being sans merit is liable to be and it is hereby dismissed. Sd/- (Parth Prateem Sahu) Judge Balram
