1. The Civil Revision has been preferred praying for transfer of an application for Preemption under Section 8 of the West Bengal Land Reforms Act being Miscellaneous Case No. 66/2025 (pre-emption) pending before the Learned Civil Judge (Junior Division), 1st Court at Bongaon, District- North 24 Parganas to the Court of Learned Civil Judge (Junior Division) at Alipore, District-South 24 Parganas.
2. It is the contention of the learned counsel for the petitioner herein, that the opposite party no. 1 is the Secretary of the Bongaon Bar Association and the petitioner thus 1
2 apprehends that he will not get a proper hearing before the Trial Court and as such the prayer has been made for transfer of the case to Alipore Court. The petitioner also submits that Barasat Court is nearer to Bongaon Court.
3. On hearing the learned counsel for the petitioner, this Court finds that the petitioner has prayed for transfer of the case to Alipore which is at a long distance from Bongaon but Barasat Court is nearer to Bongaon Court. The petitioner’s apprehension prima facie appears to be well founded.
4. Considering
the
facts
and circumstances, and keeping in mind the convenience of both parties herein,
it
is
directed
that Miscellaneous Case No.66 of 2025 be withdrawn from the Court of Learned Civil Judge (Junior Division), 1st Court at Bongaon, District- North 24 Parganas and be transferred to the Court of Learned Civil Judge (Junior Division), 1st Court, Barasat, North 24 Parganas.
5. Learned Civil Judge (Junior Division), 1st Court, Barasat, North 24 2
3 Parganas shall proceed with the suit in accordance with law upon due notice to both the parties.
6. Keeping in mind the case of the opposite party herein, the Learned Civil Judge (Junior Division), 1st Court, Barasat, North 24 Parganas shall be at liberty to permit the opposite party to appear virtually, if such prayer is made.
7. CO 216 of 2026 is disposed of.
8. Parties to act on the server copy of this order.
9. Let a copy of this order be sent to the concerned Courts for immediate compliance. ( Shampa Dutt (Paul), J. ) 3
