These are the first bail applications filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No. 127/2026 registered at Police Station- City Kotwali, Dhamtari, District- Dhamtari (C.G.) for the offence punishable under Sections 115(2), 191(2), 191(3), 296, 331(6) and 351 (2) of BNS. 2. Learned counsel for the applicants submits that, at the time of registration of the FIR, offences punishable under Sections 115(2), 191(2), 191(3), 296, 331(6) and 351(2) of the Bharatiya Nyaya Sanhita, 2023 were registered against the present applicants. It is submitted that during the course of investigation, Section 117(2) of the BNS was also added. Learned counsel
3 further submits that the investigation has been completed and the charge-sheet has already been filed before the competent Court. 3. Per contra, learned State counsel submits that during the course of investigation, Section 117(2) of the BNS has been added against the applicants. It is contended that the present bail application has not been preferred seeking bail in respect of the said added offence and, therefore, the present application has become infructuous in its present form. 4. In view of the submission made by learned State counsel, learned counsel for the applicants seeks permission to withdraw the present bail application with liberty to file a fresh bail application taking into account the subsequently added offence. 5.
Considering the aforesaid submissions and without expressing any opinion on the merits of the case, the present bail application is dismissed as withdrawn, with liberty reserved to the applicants to file a fresh bail application in accordance with law, if so advised. Sd/-
