Bibi Tanjema Vs. The State of West Bengal & Ors.
Mr. Piyush Chaturvedi, Ld. Sr. Adv., Ms. Munmun Tiwari, Mr. Niladri Saha, Mr. Dipjyoti Chakraborti, Ms. Madhurima Basu
…..for the Appellant.
Mr. D. N. Ray, Ld. GP, Mrs. Sarda Sha
….for the State. Mr. Gangadhar Das, Mr. Tanmoy Chattopadhyay
….for the Respondent Nos.5 to 16.
1. Affidavit-of-service filed on behalf of the appellant is taken on record.
2. The appeal arises out of an order dated May 29, 2026 passed in W.P.A. 12134 of 2026.
3. By the order impugned, Her Lordship had allowed the meeting to proceed in accordance with law and had made the result of the meeting subject to the result of the writ petition.
4. We are not in agreement with Mr. Chaturvedi, learned senior advocate, who appears on behalf of the appellant that Her Lordship misconstrued the provisions of law. There is nothing on record which would show that either the requisition was invalid or that the
2 prescribed authority had issued the notice of the meeting contrary to the law.
5. We are however of the, prima facie, opinion that the writ petition has become infructuous in view of the order passed in the subsequent writ petition being W.P.A. 12744 of 2026 on June 15, 2026, in respect of the same meeting. It is upto the parties to take appropriate steps in the writ petition.
6. Under such circumstances, the appeal and the connected application are dismissed.
7. Urgent Photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
