JUSTICE P SREE SUDHA ORAL ORDER Learned counsel for the petitioner is present and submits that he has served copies to learned counsel for respondent appearing before the trial Court and filed a memo to that effect. Hence, notice against respondent is held sufficient. There is no representation on behalf of the respondent 2. Though this matter is listed for orders, it is taken up for final hearing and disposed of by this order. 3. This transfer petition is filed by wife for transfer of M.C.No.74/2023 filed by husband for divorce before the Additional Senior Civil Judge and JMFC, Doddaballapura to the Principal Judge, Family Court, Kolar. As she is residing in kolar along with her parents and minor child aged 6 years. She is not working and earning. The distance between both the places is - 3 - HC-KAR NC: 2026:KHC:33089 CP No. 105 of 2026 85 kilometers. It is inconvenient for her to travel along with the minor child. It is further stated that respondent neglected to provide basic amenities to the child and also harassing her physically and mentally and there is serious threat to her life and to the minor child. No other cases are pending before the Family Court. It is submitted that husband is an agriculturist and he is residing in Doddaballapura and he has filed for divorce before the concerned court. 4. Considering the arguments of learned counsel for the petitioner, in the absence of respondent's arguments, this court finds it just and reasonable to transfer M.C.No.74/2023 from Additional Senior Civil Judge and JMFC at Doddaballapura to Principal Judge, Family Court, Kolar.
