This is the second bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicant, who has been arrested in connection with Crime No.857/2023, registered at Police Station - Sarkanda, District Bilaspur C.G, for commission of offence punishable under Sections 302 of IPC. 3. Case of the prosecution case, in brief, is that on 26.06.2023, a merg intimation bearing registration No.57/2023 was registered at Police AKHILESH BEOHAR Digitally signed by AKHILESH BEOHAR Date: 2026.07.14 16:52:17 +0530 2 Station Sarkanda on the information furnished by Vijay Sharma wherein it is alleged that informant’s sister- Roma Bajpai was married to the present applicant about four years prior to the incident. After the marriage, she resided at her matrimonial home, where the applicant, allegedly addicted to liquor, used to subject her to physical assault. Owing to frequent quarrels and harassment, she returned to her parental home and expressed her unwillingness to reside with the applicant. It is further alleged that the applicant came near the informant’s house, abused the informant and his brother- Ajay Sharma in filthy language and thereafter called Ajay Sharma near his own house, where he allegedly assaulted him with a knife. As a result of the injuries sustained in the incident, Ajay Sharma died. On the basis of the aforesaid allegations, present crime has been registered against the applicant. 4. Learned counsel for the applicant submits that this is the second bail application of the applicant and the first bail application was dismissed on merits vide order dated 03.11.2025 passed in MCRC No.8467 of 2025. It is further submitted that out of 23 prosecution witnesses, only 14 witnesses have been examined so far and the applicant is in jail since 27.06.2023. Therefore, it is prayed that the learned trial Court be directed to conclude the trial expeditiously. 5. On the other hand, learned counsel for the State opposes the bail application and submits that no new ground has been made out for grant of bail after dismissal of the applicant’s earlier bail application on merits. He further submits that only a few prosecution witnesses remain to be examined and, therefore, no case for entertaining the present bail application is made out. 3 6. Heard learned counsel for the parties. 7. Considering the entire facts and circumstances of the case and the material available on record, and in particular, the fact that no subsequent change in circumstances or new ground has been shown after dismissal of the applicant’s first bail application on merits, this Court is not inclined to reconsider the prayer for grant of bail. 8. Accordingly, the second bail application stands dismissed. 9. However, considering the fact that the applicant is in jail since 27.06.2023, and that only 14, out of 23 witnesses have been examined till date, the learned trial Court is directed to make every endeavour to conclude the trial as expeditiously as possible, preferably within a period of six months from today, without being influenced by any observation made herein. 10. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/- (Radhakishan Agrawal) Judge Akhilesh
