For the State : Mrs. Lily Sahay, A.P.P. ------ 03/ 17.09.2026 Heard learned counsel for the petitioner and learned A.P.P for the State. 2. The petitioner is apprehending his arrest in connection with Baliapur P.S. Case No. 143 of 2022, for offence registered under Sections 147, 148, 149, 323, 353, 341, 342, 504 and 506 of Indian Penal Code, pending in court of learned Judicial Magistrate, 1st Class, Dhanbad. 3. Learned counsel appearing for the petitioner submits that allegations are made against 600 to 700 persons and there is no specific allegation against any of the accused persons. He further submits that there are more than one FIR has been filed for the same offence. He then submits that in identical situation several other co-accused persons have already been granted anticipatory bail in ABA Nos. 3652 of 2023, 8072 of 2023, 2809 of 2023 and 4501 of 2026. He next submits that the petitioners have got no criminal antecedent as disclosed in paragraph No. 10 of the petition. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner. [ 2026:JHHC:28141] -2- 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the petitioner was also the member of unlawful assembly. On this ground, she submits that anticipatory bail may kindly be rejected. 5. It transpires that there are general and omnibus allegation in the FIR against 600 to 700 persons and the petitioners have got no criminal antecedent as disclosed in paragraph No. 10 of the petition and in identical situation several other co-accused persons have already been granted anticipatory bail in the aforesaid A.B.As., I am inclined to provide the privilege of anticipatory bail to the petitioner, named above. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad, in connection with Baliapur P.S.
