This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No. 3468 of 2026 to its original file.
Learned counsel for the petitioner submits that B.A. No. 3468 of 2026 was dismissed for non-compliance of peremptory order of filing the supplementary affidavit. It is next submitted that due to inadvertence, the said supplementary affidavit could not be filed within the stipulated time for non-filing of which B.A. No. 3468 of 2026 was dismissed. It is further submitted that non-compliance of peremptory order was neither deliberate nor intentional. It is then submitted that the said supplementary affidavit has already been filed. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No. 3468 of 2026 and unless B.A. No. 3468 of 2026 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No. 3468 of 2026 be restored to its original file.
Considering the aforesaid submission of the learned counsel for the petitioner and the facts of this case, B.A. No. 3468 of 2026 is
restored to its original file to the stage at which, it was before its dismissal.
List B.A. No. 3468 of 2026 under the appropriate heading before the appropriate bench after a week.
