Learned advocate appearing for the petitioner submits that the petitioner has been implicated for alleged recovery of 313 grams of Brown Sugar and he is in custody for one year and two months. 2. Learned advocate for the State, on the other hand, opposes the prayer for bail on the ground of commercial quantity of contraband being seized and the same is seized from the possession of the present petitioner. Additionally, it has been submitted that the petitioner has other criminal antecedents. Page 2 3. I have taken into account the period of detention of the present petitioner and the petitioner is on bail in the other cases. Having regard to the results of the chemical examiner which reflects presence of Diacetylmorphine, Monoacytylmorphine and Morphine and the judgment of the Hon’ble Supreme Court of India rendered in the case of Sentu Seikh vs. State of West Bengal [SLP (Crl.) No.13987 of 2025], I am inclined to release the petitioner on bail. 4. Accordingly, the prayer for bail of the petitioner is allowed. 5. As such, the petitioner, namely, Md Enamul Haque @ Enamul shall furnish bond of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court, NDPS Act, Raiganj, Uttar Dinajpur. 6. If on bail, the petitioner shall be physically present on each and every date before the learned Trial Court in seisin of the case. The petitioner shall not leave the district of Uttar Dinajpur without prior permission of the concerned Court. 7. Accordingly, CRM(NDPS) 1347 of 2026 is disposed of. 8. Memo of evidence filed by the State be kept with the record. 9. Case diary be returned to the learned advocate appearing for the State. 10. All parties shall act on the basis of server copy of this order duly downloaded from the official website of this Court. Page 3 11.
