JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.6 in Crime No.56/2026 registered by Konanakunte Police Station, Bengaluru for the offences punishable under Sections 316(1), 318(2), 61(2) and 336(3) of the Bharatiya Nyaya Sanhita (BNS), 2023 is before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail. 2. Heard learned counsel for the parties. 3. FIR in Crime No.56/2026 was registered by Konanakunte Police Station, Bengaluru for the aforesaid offences against Haritha.M.G and others based on the first information dated 21.02.2026 received from Kumaresh.D, authorized representative of a financing company known as Repco Home Finance Ltd. In the said case petitioner is arraigned as accused No.6, apprehending his arrest he had - 3 - HC-KAR NC: 2026:KHC:33651 CRL.P No. 8947 of 2026 filed Crl.Misc.No.3203/2026 which was rejected on 23.04.2026. Therefore, he is before this Court. 4. Perusal of material on record will go to show that accused Nos.1 and 2 along with accused Nos.3 and 4 had approached the financing company for purchase of certain properties and also had submitted documents of the said properties to avail financial assistance from the company. It appears that the documents submitted by accused Nos.1 and 2 were forwarded to the petitioner herein who was the panel advocate for the financing company and based on the legal opinion of the petitioner as well as the report of the approved property valuer of the company, a loan of Rs.49,90,000/- was sanctioned by accused No.8- Basavaraj. The said loan was sanctioned in the month of November, 2023. It is only after the borrowers had failed to repay the loan amount, in the month of February 2026, the company had approached the police. - 4 - HC-KAR NC: 2026:KHC:33651 CRL.P No. 8947 of 2026 5. Considering the aforesaid aspects of the matter, accused No.8-Manager of the bank has been granted anticipatory bail by this Court in Crl.P.No.6226/2026. Subsequently, accused Nos.1 to 4 have been granted anticipatory bail by this Court in Crl.P.No.4892/2026 and Crl.P.No.6265/2026. The petitioner who is a practicing advocate has undertaken to co-operate with the police for the purpose of investigation. Under these circumstances, the following: ORDER The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.56/2026 registered by Konanakunte Police Station, Bengaluru for the offences punishable under Sections 316(1), 318(2), 61(2) and 336(3) of BNS, 2023, subject to the following conditions: - 5 - HC-KAR NC: 2026:KHC:33651 CRL.P No. 8947 of 2026 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co- operate with the police for investigation and appear before them whenever called upon. 4.
