This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.03/2026 registered at Police Station Komakhan Distt.- Mahasamund (C.G.), for the offence punishable under Section 20(b)(ii)(c) & 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and also under Section 338, 336(3) & 340(2) of BNS. Case of the prosecution, in brief, after getting the secret information about transporting Ganja in Ambulance of Force Travelers bearing no OD 02 AX 5501, the raid was performed and total 520 Kilogram contraband i.e. Ganja was seized/recovered from the possession of the co-accused person namely Sagar Vagh S/o. Gokul Vagh, Sanjay Ahire S/o. Gokul Ahire & Sushil Dabhade S/o. Krishna Dabhade and they were also having forge number plate with them and, thereafter, during the course of investigation, the name of the present applicant was also came into light and consequently, he was arrested and offences aforesaid were registered against him. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. He further submits that applicant has not played any active role as he is not the driver or owner of the alleged vehicle involved in manufacturing, purchasing, selling, importing, exporting or using any psychotropic substance. He also submits that the applicant has been made an accused on the basis of memorandum statement of co-accused. He later submits that the applicant has no criminal antecedent and he is in jail since 25.01.2026 and the conclusion of the trial is likely to take quite long time. Therefore, he prays for grant of regular bail to the applicant. 4.
On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the charge-sheet has been filed in the present case before the competent Court and submits that the applicant has no criminal antecedent. He further submits that the applicant and other co-accused persons are involved in illegal sale and purchase of contraband (Ganja) and, even otherwise, the contraband article (ganja), which has been seized in
3 the present case is around 520 Kg, which is more than commercial quantity, therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. From perusal of the case diary, it transpires that an ambulance bearing No.OD-02-AX-5501 was caught by the police, in which, 520 KG of illegal contraband (Ganja) was recovered from the possession of co-accused- Sagar, Sanjay and Sushil and, thereafter, when the memorandum statement of these co-accused persons were recorded, Sagar (co-accused) informed that on instruction of Ramdas Sonwane @ Rambhau and Akash Manohar he along with other co-accused person went to Odisha and loaded 520 KG of Ganja from one Ranjan Durga. Their Ambulance was also piloted by two vehicles, Swift bearing No. M. H. 12 U.N. 9892 was driven in which Akash Jadhav and Aditya Pakhare were sitting and Victrus bearing No.O.D. 08 A.A. 6497 was driven in which Ramdas Sonwane and Ranjan Durga were sitting. Further, memorandum of was Ranjan Durga was recorded in which he has stated that the Ganja was supplied by him to Ramdas Sonwane and Akash Jadhav. He was piloting the offended vehicle/ ambulance in which Ganja was being transported. It was revealed that Ramdas Alias Rambhau Sonwane used to purchase and sell the Ganja and by doing this illegal activity, the amount for selling and purchasing the Ganja was deposited in the Bank Account of present Applicant.
As such, it cannot be said that it is a case of false implication and, even the trial is also in progress and the contraband which is said to have been recovered in the present case is around 520 kg, which is more than commercial quantity. Consequently,
4 under these circumstances, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of the applicant- Kunal Ramdas Sonwane, involved in Crime No.03/2026 registered at Police Station Komakhan Distt.- Mahasamund (C.G.), for the offence punishable under Section 20(b)(ii)(c) & 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 and also under Section 338, 336(3) & 340(2) of BNS, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. - Sd/-
