JUSTICE BISWAJIT PALIT Order 29/04/2026 This Writ Appeal is preferred by the appellant challenging the judgment dt.17.01.2026 in WP(C) No.705/2024 contending that the learned Single Judge should have also awarded Dearness Allowance in addition to the benefit of minimum of pay scale of a Group-D employee to the appellant for the period three years preceding the date of filing of the said Writ Petition. 2. Counsel for the appellant contends that the Government of India has issued instructions on 04.09.2019 [Annexure-A/5] entitling the casual workers also to get Dearness Allowance. 2026:THC:555-DB 3. Admittedly the appellant is not an employee of the Government of India, but an employee of the State Government. 4. Therefore, the said Government of India instructions dt.04.09.2019 cannot be taken advantage of by the appellant. 5. In this view of the matter, we find no merit in the Writ Appeal.
