4 THESE APPEALS COMING ON FOR CONCILIATION BEFORE LOK ADALAT, THE FOLLOWING CONCILIATION ORDER IS PASSED:
CONCILIATION ORDER
1. MFA No.111/2023 is filed by the KSRTC praying to set aside the Judgment and Award dated 29.07.2022 in MVC No.273/2021, on the file of AMACT, Sira.
2. MFA No.2778/2023 is filed by the claimants assailing the
Judgment and Award dated 29.07.2022 in MVC No.273/2021, on the file of AMACT, Sira, seeking enhancement of compensation.
3. The learned counsel appearing for the respondents - claimants is present. The learned counsel appearing for the appellant - KSRTC along with its representative are present.
4. After prolonged negotiations, the matter is settled. Both side parties have filed a Joint Memo. The Joint Memo is signed by the learned counsel appearing for the respondents - claimants (being authorized by the appellant/s - claimant/s to sign) and
5 the learned counsel appearing for the appellant - KSRTC and its authorized Officer. The respondents - claimants have agreed to receive and the appellant - KSRTC has agreed to pay a lumpsum of Rs.20,00,000/- (Rupees Twenty Lakh only) instead of what has been awarded by the Claims Tribunal, in full and final settlement of the claim.
5. The appellant - KSRTC has agreed to deposit the said amount before the Tribunal within six weeks from the date of preparation of award, failing which the said amount shall carry interest at the rate of 9% p.a. from the date of default, till the date of deposit.
6. The Joint Memo is accepted. The entire compensation amount Rs.20,00,000/- shall be released in favour of the respondents – claimants, in the ratio ordered by the Claims Tribunal.
7. The MFA No.111/2023 and the MFA No.2778/2023 stand disposed of in terms of the Joint Memo. The Judgment and Order dated 29.07.2022 in MVC No.273/2021, on the file of
6 AMACT, Sira shall stand modified accordingly. Draw up the Award accordingly.
8. The statutory amount in deposit in MFA No.111/2023 be transmitted to the concerned Tribunal, forthwith.
