BEFORE HONOURABLE MRS. JUSTICE YARENJUNGLA LONGKUMER ORDER Date : 23.01.2026 Heard Mr. T. T. Tara, learned counsel for the petitioner. Also heard Mr. T. Ete, learned Additional Public Prosecutor for the State respondent. 2. The present application under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been filed praying for grant of pre-arrest bail to the applicant in connection with Wakka P.S. Case No. 03/2025 dated 29.12.2025
Page No.# 2/3 registered under Section 75/80/81 of the Juvenile Justice (Care and Protection of Children) Act, 2015, read with Section 143(2)/108 of the BNS, 2023. 3. The respondent No. 2 is the Child Welfare Committee, Longding District, who has filed suo moto complaint in the present case. 4. On 07.01.2026, this Court had issued notice and granted interim pre-arrest bail in favour of the accused person, namely, Smti. Toko Odi, and one of the conditions was that the accused/applicant would appear before the investigating officer and record her statement within a period of 7 (seven) days from the date of the order. 5. It is submitted by the petitioner that the accused has complied with the direction of this Court and she has appeared before the investigating officer and her statement has been recorded. The learned counsel for the petitioner has also submitted that there is no allegation or report from the investigating agency that the accused person has violated any of the conditions set out by this Court in the interim order dated 07.01.2026. It is accordingly prayed that the interim pre-arrest bail be made absolute at this stage. 6. The learned Additional Public Prosecutor has produced the copy of the status report dated 23.01.2025. 7. Upon going through the same, it is seen that the alleged accused has appeared before the I.O and her statement has been recorded. A copy of the statement of the alleged accused is also produced by the learned Additional Public Prosecutor. 8.
The status report submitted by the I.O on 23.01.2025 also reveals that the
Page No.# 3/3 alleged accused upon appearance before the investigating authority was arrested and bail bond was executed. The I.O has not made any objections or made any allegation regarding non-cooperation by the accused in the status report. 9. Upon consideration of the above fact and circumstances, this Court is inclined to allow this petition and the interim order dated 07.01.2026, is hereby regularized and made absolute on the same terms and conditions with the additional conditions that the alleged accused shall continue to appear before the investigating agency as and when summoned and shall cooperate fully with the investigation process. 10.
