JUSTICE RAVI V HOSMANI - 3 - HC-KAR NC: 2026:KHC:32895 WP No. 4399 of 2022 ORAL ORDER This writ petition is filed for following reliefs: a) Issue a writ of certiorari or any other appropriate writ, order, quashing the proceedings in PCR No.453/2021 pending before the Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru (Annexure- G) and in Cr.No.0190/2021 pending on the file of the 1st respondent Whitefield Police Station, Bengaluru-560075 (Annexure-H) as the same are illegal, arbitrary and in violation of Article 21 of the Constitution of India and the right to liberty has been infringed. b) Issue a writ of mandamus or any other appropriate writ, order or direction directing the respondents to grant all the consequential benefits consequent upon quashing the proceedings at Annexure-G & H and etc." 2. Sri Madan N, learned counsel appearing for petitioners submitted that respondent no.2 had filed a private complaint in PCR No.453/2021 on file of Additional Chief Judicial Magistrate, Bangalore Rural District, Bengaluru as per Annexure-G, in pursuance of which, Crime No.190/2021 was registered by Whitefield Police Station, Bangalore. Grievance in complaint was about non-performance of terms of Joint Development - 4 - HC-KAR NC: 2026:KHC:32895 WP No. 4399 of 2022 Agreement etc. which was purely civil in nature and ultimately was subject matter of Arbitration case no.153/2023. Despite same complaint was registered. Assailing same, this petition is filed. 3. Learned counsel further submitted that during pendency of above petition, Arbitration Case No.153/2023 was disposed of in terms of a compromise entered into between parties as per which, respondent no.2/ complainant had agreed to withdraw FIR giving rise to Crime no.190/2021 impugned herein. Therefore, learned counsel for petitioners seeks for quashing of same. 4. Learned counsel for respondent no.2/complainant would concur with submission. 5. Learned High Court Government Pleader appearing for respondent no.1/State opposed submission on ground that allegations against petitioners/accused were for commission of offences punishable under Sections 120B, 420 and 406 of IPC one of which was non- - 5 - HC-KAR NC: 2026:KHC:32895 WP No. 4399 of 2022 compoundable and therefore proceedings cannot be quashed. 6. Heard learned counsel for both parties and perused on record. 7. Indeed petitioners/accused in private complaint filed by respondent no.2/complainant appeared to have settled disputes as recorded in Arbitration Case no.153/2023 disposed of on 07.09.2023 and agreed not to pursue complaint. Though offence under Section 120B of IPC is non-compoundable, a perusal of private complaint indicates that dispute is purely inter-parte arising out of civil transaction, which has since ended in settlement. Therefore, no useful purpose would be served in continuation of proceedings. There are no societal impact. In view of settlement and to secure ends of justice, proceedings require to be quashed. - 6 - HC-KAR NC: 2026:KHC:32895 WP No. 4399 of 2022 Hence, petition is allowed, proceedings in PCR no.453/2021 pending before Additional Chief Judicial Magistrate, Bengaluru Rural District, Bengaluru (Annexure-G) and Cr.no.190/2021 registered by Whitefield Police Station, Bengaluru (Annexure-H) are quashed taking note of settlement between parties in Arbitration Case no.153/2023 disposed of on 07.09.2021.
