This first anticipatory bail application filed under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.223/2026 registered at Police Station Bemetara, District Bemetara (C.G.) for the offence punishable under Section 318(4) of B.N.S., 2023. 2. The prosecution's case, in brief, is that complainant lives in the same room with applicant’s son. On 11.08.2025, on the pretext of giving government job to complainant, present applicant demanded Rs.4,00,000/-. Thereafter, complainant transferred Rs.90,000/- to the DEEPTI JHA Digitally signed by DEEPTI JHA 2 applicant from his account and some amount was given in cash at different times, but when the complainant did not received the government job, he filed a complainant against the present applicant. Based on above facts, police registered case against the applicant. Hence, this application. 3. Learned counsel for the applicant would submit that the applicant is innocent and he has been falsely implicated in crime in question. It is further submitted that whole dispute is with regard to the financial transaction, the said amount has already been received by the complainant. It is further submitted that applicant has borrowed Rs.2,00,000/- from the complainant due to some financial problem and when the applicant was unable to return the said amount, the complainant lodged the false report against the applicant by giving the colour of criminal dispute. It is further submitted that the comprise took place between both the parties and the complainant received the said amount, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel for the non-applicant/State, would opposed the bail application of the applicant and submitted that there are 8 criminal antecedents registered against the present applicant and committed the fraud with the complainant. It is further submitted that bail of the applicant was also rejected by the Second Additional Sessions Judge, Bemetara, District Bemetara, therefore, applicant may not be enlarged on bail. 5. Learned counsel appearing for the objector submits that compromise has been took place between the parties and the complainant received the alleged amount and he does not want to prosecute the case further. 3 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts & circumstances of the case, particularly the fact that on the pretext of giving of government job to the complainant, present applicant demanded alleged amount has been demanded by him. Further considering the fact that bail of the applicant was also rejected by the Second Additional Sessions Judge, Bemetara, District Bemetara (C.G.) and also considering the fact that there are 8 criminal antecedents registered against the present applicant, therefore, without commenting anything on merits, I am not inclined to grant anticipatory bail to the applicant. 8. Accordingly, the anticipatory bail application of the applicant – Tarachand Rathore, involved in Crime No.223/2026 registered at Police Station Bemetara, District Bemetara (C.G.) for the offence punishable under Section 318(4) of B.N.S., 2023, is rejected.
