The petitioner's notice dated 19.01.2026 would be notice as contemplated under Section 21 of the Arbitration and Conciliation Act, 1996 [for short, the ‘Act’]. It is obvious on perusal of the response that the respondent does not dispute the agreement for arbitration of the dispute and in fact the respondent - 3 - HC-KAR NC: 2026:KHC:27554 CMP No. 99 of 2026 has sought leave to raise a counterclaim against the petitioner.
