JUSTICE ASHOK S.KINAGI ORAL ORDER The petitioners have filed this writ petition seeking the following reliefs: a) Issue a writ of mandamus or any other order or direction, directing the respondents 1 to 3 to take suitable action to transfer the petitioners to any other Private Aided ITI Institution or Government ITI Institutions where vacancies in the cadre of Junior Training Officer (JTOs) are available with a further direction to extend all consequential service benefits to them, in the interest of justice. b) Issue writ of mandamus or any other writ, order or direction, directing respondents 1 to 3 to take suitable action to recover the salary and emoluments payable to the petitioners from the month of March 2015 from the 5th and 6th respondents and pay the same to the petitioners herein, in the interest of justice and equity. - 5 - HC-KAR NC: 2026:KHC:29261 WP No. 47496 of 2018 c) Pass any other appropriate suitable orders or directions as this Hon’ble Court deems fit and necessary in the interest of justice and equity. 2. Brief facts, leading rise to the filing of this petition are as follows: The petitioners are the permanent employees working as the Junior Training Officers in respondent No.7- Institution. Their appointments were admitted with benefit of the grant in aid from the Government. The institution was run by 5th respondent-Trust, which is managed by the sole Managing Trustee-respondent No.6. Respondent No.7-Institution was closed. The petitioners sought transferring them to the other private Aided ITI Institution or Government ITI Institution. Hence, prays to allow the writ petition. 3. Heard the arguments of the learned counsel petitioners and also learned Government Advocate for respondent Nos1 to 4. - 6 - HC-KAR NC: 2026:KHC:29261 WP No. 47496 of 2018 4. Learned counsel for the petitioners submits that in similarly placed petitioners approached this Court in W.P.No.56092/2018 against the very same respondent No.7-Institution. The said writ petition came to be disposed of vide order dated 12.02.2026. The petitioners have entitled for similar relief on the ground of parity. Hence, on this ground, he prays to allow the writ petition in terms of the order passed by this Court in W.P.No.56092/2018. 5. Learned Government Advocate in the said writ petition submitted that, in view of new Rules framed by the State Government amending the Grant-in- ITI Rules, 2025, the case of the petitioners will be considered in accordance with law. The similarly placed petitioners have approached this Court in the aforesaid writ petition. The Co-ordinate Bench of this Court disposed of the writ petition vide order 12.02.2026. The petitioners are also entitled to a similar relief in the instant writ petition on the ground of parity. - 7 - HC-KAR NC: 2026:KHC:29261 WP No. 47496 of 2018 6. In view of the above submission, without expressing any opinion on the merits of the case, the writ petition is disposed of. 7. Respondent No.2 is directed to consider the representation of the petitioners in accordance with the law and pass an appropriate order within a period of four weeks from the date of receipt of copy of this order. 8.
