This bail application has been filed on behalf of the accused- petitioner under Section 483 of B.N.S.S. in connection with FIR No. 2/2024 registered at Police Station Special Police Station (SOG), District ATS and SOG for the offence(s) under Section(s) 419, 420, 467, 468, 471 and 120-B of IPC and under Sections 3, 4 and 6 of The Rajasthan Public Examination (Prevention of Unfairmeans) Act, 1992. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has been falsely implicated in this case and the accused-petitioner is behind the bars since 04.01.2026. He further submits that the similar situated co-accused persons namely Ummed Singh and Harsan Ram @ Harish @ Harchand have [2026:RJ-JP:10863] (2 of 3) [CRLMB-1829/2026] already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 05.08.2025 in S.B. Criminal Miscellaneous Bail Application No. 7146/2025 and 29.01.2025 in S.B. Criminal Miscellaneous 2nd bail Application No. 1333/2025 respectively. He further submits that the alleged offences are triable by Magistrate and conclusion of trial will take its own time, so no fruitful purpose would be served by keeping the accused-petitioner in custody and therefore, prays that the accused-petitioner may be granted the benefit of bail under Section 483 of BNSS. 3. Per contra, learned Public Prosecutor vehemently opposes the bail application and submits that there is one another criminal antecedent against the accused-petitioner. 4. The alleged offences are triable by Magistrate and trial will take its own time. Without expressing any opinion on the merits/demerits of the case, this Court deems it just and proper to enlarge the accused-petitioner on bail. 5.
