Petitioner has filed this writ petition seeking following reliefs. “10.1 That the Hon’ble Court may kindly be pleased to call for the entire records from the respondent no. 1 and 2. 10.2 That, it is respectfully prayed that this Hon’ble Court may kindly be pleased to issue writ of mandamus and kindly direct the respondent No. 1 and 2 to decide the complaint/ representation dated 28.12.2019 of the petitioner within any stipulated time. 10.3 That, it is respectfully prayed that this Hon’ble Court may kindly be pleased to direct the PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 respondent authorities to recover the tax amount of Rs. 2,72,53,440 from the respondent No. 3. 10.3 Any other relief which the Hon’ble Court may deem fit and proper may also be granted in favour of the petitioner.” 2. Learned counsel for petitioner submits that petitioner has made a complaint to Respondent No. 2 against Respondent No. 3, based on which cognizance was taken and the Transport Commissioner, Raipur has issued a letter to the Assistant Transport Commissioner, Raipur directing to initiate proceedings for recovery of tax. The said letter is dated 02.01.2020. However, till date no proper steps have been taken in compliance with the letter Annexure P-2 dated 02.01.2020. 3. Learned State counsel submits that based on the complaint, steps have been taken for recovery of tax due to Respondent No. 3. 4. I have heard learned counsel for the respective parties. 5. The complaint filed by petitioner before Respondent No. 2 is dated 28.12.2019 and pursuant to the complaint, letter is issued by the Transport Commissioner, Raipur, on 02.01.2020 to the Assistant Transport Commissioner, Raipur for recovery of the tax due from Respondent No. 3. The said letter is about more than five years old. None of the counsel for the parties have made submission before this Court as to whether any further steps have been taken in this regard based on the letter issued by the Transport Commissioner. 6. Be that as it may, submission of learned counsel for petitioner is that pursuant to letter Annexure P-2 no further proceedings have been drawn. In above facts of the case, I find it appropriate to dispose of this writ petition at this stage, directing Assistant Transport Commissioner, Raipur to comply with the letter dated 02.01.2020 issued by the Transport Commissioner, Raipur, in accordance with law, expeditiously, if already not acted upon.
