The applicants have preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending their arrest in connection with Crime No. 154/2026, registered at Police Station – Pendra, District – Gaurela- RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 Pendra-Marwahi (C.G.) for alleged commission of offence punishable under Section 331(6), 324(4), 296, 351(3), 115(2) and 3(5) of the BNS. 2. As per the prosecution story in brief, is that complainant made a written complain on 18.05.2026 regarding the incident dated 16.05.2026 before the concern police station, she would further stated that on 16.05.2026, complainant and her mother went to Anuppur for some work, at that time Ranu Gupta, her brother Himanshu Gupta and one another Anurag Giri Goswami were presented at home on the same date at about 11 pm, applicants were came to the complainant house and started abuse with them and also assaulted to them, due to the assault they have received injury in the back and thighs and applicants also damage the household items, and after sometime they left the house of complainant. That the complainant returned from the house at about 1 am and enquired about all the matter and lodged an FIR against them. That the concerned police station registered the FIR against the applicants. Hence, this application. 3. The learned counsel for the applicants has argued that due to the previous enmity complainant lodged an false FIR against the aplicants because an earlier family member of the applicant lodged an FIR against the Himanshu Gupta and Anurag Giri. Hence, he prays for grant of anticipatory bail to the applicants. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that the applicants are said to have entered the house of the complainant and assaulted the two injured persons and they received injuries in their back and thighs and 3 applicants also damage the household items, and there is one criminal antecedent of the applicant No.3. Therefore, the present anticipatory bail application of the applicants is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, allegations levelled against the applicants in the FIR, it transpires that the applicants are said to have entered the house of the complainant and assaulted the two injured persons and they received injuries in their back and thighs and applicants also damage the household items, and there is one criminal antecedent of the applicant No.3, thus, I am not inclined to grant anticipatory bail to the applicants. 7. Accordingly, the Anticipatory Bail application of the applicants – Chandrashekhar @ Bholu Kewart, Arvind Kewart, Ramdulare Kewart and Ram Sanjivan Kewart, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 154/2026, registered at Police Station – Pendra, District – Gaurela-Pendra-Marwahi (C.G.) for alleged commission of offence punishable under Section 331(6), 324(4), 296, 351(3), 115(2) and 3(5) of the BNS, is rejected.
