Order on Board 09.07.2026
1. This first anticipatory bail application filed under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending her arrest in connection with Crime No.89/2026 registered at Police Station Frezerpur, District Bastar (C.G.) for the offence punishable under Section 303(2) of B.N.S., 2023. 2. The prosecution's case, in brief, is that the complainant, Ramji Yadav, who is the registered owner of a 10-wheeled truck bearing registration number CG-18-R-8047, which was routinely operated under the Bastar DEEPTI JHA Digitally signed by DEEPTI JHA
2 Transport Sangh. In August, 2025, the complainant parked his vehicle adjacent to the B.R. Cold Storage facility. On 25.08.2025, the complainant suffered a severe paralytic stroke that left his left side non- functional. He was initially admitted to the hospital and subsequently shifted to Telangana, by his family for specialized medical treatment, where he remained hospitalized for nearly 4 to 5 months. Upon recuperating, the complainant returned to Jagdalpur on 15.03.2026. When he visited the parking spot next to the B. R. Cold Storage to inspect his vehicle, he discovered that the truck was missing. Local inquiries led him to discover that the applicant/accused, Ankit Yadav, had allegedly taken the vehicle away without his authorization or consent. When the complainant confronted the applicant regarding the missing truck, the applicant eventually returned the vehicle to its original spot near the cold storage. However, upon inspection, the complainant found that the applicant had systematically removed and misappropriated six brand-new radial tyres (along with their rims and disc assemblies) from the vehicle, substituting them with worn-out, unusable tyres.
On 25.04.2026, the complainant filed a complaint at Police Station Frazerpur, alleging that the applicant took advantage of his critical illness and prolonged medical absence to dishonestly take his commercial vehicle and misappropriate valuable automobile properties Acting on this statement, the police registered case against the applicant. 3. Learned counsel for the applicant would submit that the applicant is innocent and he has been falsely implicated in crime in question. He submits that applicant did not steal the commercial vehicle, there was a mutual consent between the applicant and the complainant. Further, he
3 fairly submits that there are four criminal antecedents were registered against the applicant out which one is disposed of, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel for the non-applicant/State, would oppose the bail application of the applicant and submit that applicant took the advantage of illness of the complainant, as he was paralyzed and used the truck of complainant and also misplaced the various parts of the truck. She further submits that there are four criminal antecedents registered against the present applicant, out which only one is disposed of, therefore, applicant may not be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case and further considering the fact that applicant has four criminal antecedents of similar nature registered against him and he also took the advantage of illness of complainant, therefore, without commenting anything on merits, I am inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant – Ankit Yadav, involved in Crime No.89/2026 registered at Police Station Frezerpur, District Bastar (C.G.) for the offence punishable under Section 303(2) of the Bhartiya Nyaya Sanhita, 2023, is rejected.
