Applicant versus State Of Chhattisgarh Through- S H O Police Station Rajim District- Gariabandh Chhattisgarh ... Non-Applicant For Applicant : Shri Ujjawal Agrawal, Advocate. For Non-Applicant : Shri Sangharsh Pandey, GA. Hon'ble Shri Ramesh Sinha , Chief Justice Order on Board 13/07/2026 1. This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.389/2025 registered at Police Station Rajim, District Gariabandh (C.G.) for the offence under Sections 20(b)(ii)(C) and 20(b) (ii) (C) read with Section 29 of the NDPS Act. KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.07.14 17:11:35 +0530 2 2. Case of the prosecution is that on 20.11.2025, an information was received by the concerned Police that some persons were transporting a huge quantity of contraband (Ganja) on two motorcycles for the purpose of sale. Acting upon the information and after due compliance with the provisions of the NDPS Act, the police reached near Kali Mata Temple, Jora Talab, Beltukri Road, Rajim and intercepted the suspected persons. Upon search, co- accused persons namely, Ashish Rajawat, Bhupendra Ratre, Kushal Yadav and Chhabilal Satnami were found in conscious and joint possession of 30,400 kg of Ganja, which was duly seized. During investigation and based on the memorandum statements, co-accused persons disclosed that the seized contraband was procured from the present applicant for the purpose of illegal trade. On the basis of such disclosure and further investigation, the present applicant was arrested on 25.11.2025 and 4.118 kg of Ganja was recovered and seized from his possession. Thereafter the FIR was registered against the persent applicant and co- accused persons. Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. The name of the applicant surfaced only on the basis of the memorandum statements of co-accused persons. The alleged recovery from the applicant is highly doubtful, as there are material contradictions regarding quantity of contraband seized from the present applicant, which creates serious doubt about the 3 genuineness of the recovery. There is no independent evidence linking the applicant with the alleged contraband except disclosure of the co-accused persons. The applicant is in jail since 25.11.2025. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the bail application of co-accused has already been rejected by this Court vide order dated 6.2.2026 passed in MCRC No.1364/2026. He further submits that the applicant’s involvement has come into light during the course of investigation on the memorandum statement of co-accused persons that he used to supply contraband articles, and that the charge sheet has already been submitted against the applicant. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and the fact that the applicant’s involvement has come into light during the course of investigation on the memorandum statement of co-accused persons that he used to supply contraband articles, the bail application of co-accused has already been rejected by this Court vide order dated 6.2.2026 passed in MCRC No.1364/2026 and that the charge sheet has already been submitted against the applicant and the present appears to be a 4 organized crime, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Prem Satnami @ Bebe, involved in Crime No.389/2025, registered at Police Station Rajim, District Gariabandh (C.G.) for the offence under Sections 20(b)(ii)(C) and 20(b) (ii) (C) read with Section 29 of the NDPS Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance - Sd/- (Ramesh Sinha) Chief Justice Barve
