Agarwal, Advocate ---- 2/11.09.2026 Learned counsel appearing for the respondent State submits that counter affidavit is ready, however, the same has not been filed in the Registry as the matter was on Board and as such the counter affidavit is taken on record. 2. Heard learned counsels for petitioner and for State. 3. The petitioner is apprehending his arrest in connection with Dhansar P.S. Case No.84 of 2026, for offence registered under section 20(b)(ii)/ 29 N.D.P.S. Act, pending in court of learned Special Judge, NDPS Act-Cum-Principal District and Sessions Judge, Dhanbad. 4. Learned counsel for petitioner submits that name of the petitioner has come on confessional statement and even the Ganja in question is intermediary in quantity which is 5.218 kg which was alleged to be recovered from the apprehended co- accused. He also submits that the petitioner is having no criminal 2026:JHHC:27725 2 antecedent as disclosed in paragraph no.15 of the petition and that has also been disclosed in the counter affidavit. 5. Learned State counsel opposes prayer and submits that the name of the petitioner has come on confessional statement. 6. Considering that the name of the petitioner has come on confessional statement and even the alleged quantity of Ganja in question is intermediary which has come in the counter affidavit also filed by the respondent State and the petitioner is having no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to petitioner. 7. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Special Judge, NDPS Act-Cum- Principal District and Sessions Judge, Dhanbad, in connection with Dhansar P.S. Case No.84 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023. ( Sanjay Kumar Dwivedi, J.) 11.09.2026 SI/
