JUSTICE H.P.SANDESH ORAL ORDER The order of this Court dated 18.06.2026 reads as follows: “Heard the learned counsel for the respondent and counsel for the petitioner is absent. This Court suspended the sentence by passing a conditional order. On 19.02.2026, when the counsel for the respondent submits that conditional order of this Court has not been complied by the petitioner, this Court directed the Magistrate to proceed against the petitioner for execution of order of sentence in accordance with law. The counsel appearing for the respondent would submit that consequently, the warrant was issued and when the warrant was executed, the amount was deposited before the Court that is entire amount of fine imposed by the Trial Court. The records also disclose that - 3 - HC-KAR NC: 2026:KHC:33659 CRL.RP No. 1757 of 2025 the matter is listed before this Court subsequently after depositing the amount and today, no representation on behalf of the petitioner. It appears that in view of depositing of the entire amount, the petitioner is not interested in pursuing the matter. However, in the ends of justice, one more opportunity is given to the petitioner counsel to pursue the matter. If the counsel for the petitioner does not appear on the next date of hearing, petition will be dismissed.” 2. Inspite of aforesaid order, today also, the counsel for the petitioner is absent.
